Welcome to TAOdirectrentals.com (TDR, the “Service”). By indicating your acceptance of the following terms of service agreement, you agree to comply with its terms. Please review this Agreement thoroughly and contact us if you have any questions. If you do not agree to comply with the terms of this Agreement, you should not use the Service.
As a Host, you must be informed and agree to the following:
TDR is a vacation rental properties listing site whose sole purpose is to connect travelers with TAO hosts to facilitate direct vacation rentals. Direct rentals, without paying any commissions or extra costs, are more affordable for guests and more profitable for hosts.
You declare that you own the listed condo or have the legal rights to rent it as a property manager. You agree to provide a copy of your deed or take any other actions required by TDR to verify your ownership or right to manage the property.
By subscribing to TDR, you accept receiving emails from us containing travelers’ inquiries, news, tips, etc.
LISTING CREATION
You give TDR permission to import and publish photos, descriptions, reviews, and all available information from your existing Airbnb listing to create a similar listing on our website.
You declare that your Airbnb listing is accurate and up-to-date, and that the descriptions and photos of your condo reflect its current state. If they don’t, you agree to provide new photos and make corrections to the descriptions ASAP before they are published on TDR.
You agree to keep TaoDirectRentals informed of any future changes in your property and provide new photos, so the twin listing on TDR is always accurate.
You agree to fill out a form providing information to TDR about your payment methods and schedule, reservation deposit, security deposit, cancellation policy, etc.
You agree to pay a monthly or annual subscription fee to have your listing published on www.taodirectrentals.com, where travelers can contact you directly to book. TDR won’t charge you for creating your listing.
HOW TDR WORKS
Potential renters fill out a form on the website, and general inquiries are sent to all subscribed hosts via email, along with the number of travelers searching for accommodation and their dates. If the traveler is interested in your listing and fills out your personal form, only you will receive the inquiry.
You agree to check the email you provided during registration on a DAILY basis. If the inquiry you receive fits your availability and number of beds, you or your property manager will respond ASAP by email, including the price you want for the stay and mentioning that you are responding to the inquiry made on TDR.
TDR will reach out to travelers interested in the Riviera Maya and showcase your condo, but we cannot guarantee bookings. Once a potential renter contacts you, it’s up to you to turn that inquiry into a reservation by replying promptly and convincing them to book your property.
TDR is not an OTA (Online Travel Agency) and does not process payments from travelers, nor charge commissions or fees per booking. You (or your Property Manager) determine the best way to collect payment. Popular methods include PayPal, Zelle, Wise, Google Wallet, Venmo, and Interac e-Transfers (Canada), among others.
You are responsible for any necessary tax payments. TDR won’t collect taxes on your behalf.
TDR doesn’t charge commissions or service fees to hosts or renters. Subscription fees are reinvested in marketing efforts to reach more potential renters and cover the website’s hosting, programming, and maintenance costs.
Guarantee: If you receive no inquiries that would allow you to recover the cost of your subscription during the first year, you are entitled to have your condo listed on TDR for free the following year.
BEFORE THE BOOKING
You or your property manager commit to responding to traveler inquiries or guest questions as quickly as possible. The first hosts answering general inquiries have a much higher chance of securing the booking.
You will discuss and agree on the payment amount, method, and schedule directly with the guest, as well as disclose the cancellation policy and required security deposit. If a potential renter would like to review your contract before booking, you agree to provide a sample version of your usual rental agreement.
CONFIRMED BOOKING
Once the booking is confirmed, you will provide a rental agreement that can be digitally signed (e.g., via Adobe Acrobat Sign) by you and the renter.
You will inform your renters about TAO’s rules and ask them to respect them for a peaceful coexistence in the neighborhood. Please remember that fines for bad guest behavior will be charged to the property owner.
You must inform your property manager about the booking details ASAP, so your condo will be ready for your guest’s stay.
You or your property manager will block the dates of your direct booking on your Airbnb and other OTA calendars immediately to avoid double bookings.
You agree to inform TDR of the booking dates and your renter’s name and email, so we can ask them to leave a review after their stay.
You will provide your guest with all the instructions and necessary QR codes to ensure a smooth check-in process, as you would for friends and family. If your property manager will handle your direct bookings, they can do so on your behalf.
You commit to providing the best possible guest experience. You or your property manager will maintain fluid communication with your guests to ensure they enjoy their stay.
You will respect the agreed cancellation policy and issue refunds to your renter when necessary.
Once your direct booking is confirmed, you commit not to cancel it unless absolutely necessary, to avoid disrupting the traveler’s plans.
If you must cancel a confirmed direct booking, you agree to notify TDR ASAP so we can find your renters alternative accommodation in another available listed TAO property of their choice. You agree to send the total guest payment you have received to the chosen owner along with a copy of the signed rental agreement, or issue the renter a full refund. You will be responsible for any transfer costs.
Guest satisfaction is a top priority. Good reviews are key to encouraging more potential renters to book your property. If your guest is unsatisfied upon arrival (due to inaccurate photos, missing amenities, maintenance problems, etc.), TDR will give the traveler the option to choose another available listed TAO condo for their stay. You agree to send the full renter’s payment you have received to the owner/manager of the chosen condo immediately, and fix the issues that led to the problem ASAP to continue having your condo listed on TDR. If the guest doesn’t choose another condo, you agree to issue a full immediate reimbursement so they can rent another accommodation. Transfer fees will be on your side in any case.
AFTER THE BOOKING
After the trip, your guest will have the option to write a review about their stay at your condo. It will be published as is.
You will not hold TDR responsible for any loss or damage to your property caused by guests who rented with you directly. You can protect your condo and its contents by requiring a security deposit from the guest and taking out an insurance policy. Liability insurance is also highly recommended for vacation rental properties.
You will return the security deposit paid by the guest within the first week after departure in full after inspection, if no item of your property has been damaged or gone missing, no extra guests have stayed over without permission, and no excessive electric usage has been detected. Depending on the seriousness of any eventual damage, you will issue a partial refund of the security deposit or no reimbursement at all.
TDR will not arbitrate any dispute between you and your guests.
TDR will receive a copy of each traveler’s inquiry made through the website’s forms. (The potential guest’s email will be kept for marketing purposes with their consent.)
You agree to provide accurate feedback to TDR on follow-up emails asking about the result of inquiries you have received from potential renters. This helps measure the site's effectiveness and make course corrections to get more bookings for you and the other hosts.
TERMINATION
If you want to cancel your plan, you must give TDR at least 2 weeks' notice by sending an email to info@taodirectrentals.com with the subject line "Subscription cancellation." The amount you have already paid for the current month or year won’t be reimbursed, but you won’t be charged for the next period. TDR may terminate this Agreement, your Service subscription, or any property advertisement for any reason and without notice.
DISCLAIMER
Obligations of Hosts and Renters:
Dealings between Hosts and Renters are between them exclusively and do not involve TDR. It is the sole responsibility of each Host and Renter to take whatever precautions they may deem necessary prior to transactions with other Hosts or Renters, whether online or in person. You use the Service at your own risk. TDR is under no obligation to investigate the background of any Host or Renter.
As a Host, it is your obligation to truthfully and accurately describe all properties you advertise through the Service, and to complete all transactions and fulfill all associated obligations. You agree that your failure to fulfill such obligations may subject you to legal action by a Renter, and the suspension or termination of your access to the Service.
Hosts and Renters are solely responsible for complying with all applicable laws and regulations applicable to their use of the Service and any transactions they may enter into, including laws and regulations in connection with the collecting, reporting, and payment of taxes, zoning and permitting, safety, accessibility, discrimination, and fair housing.
INDEMNIFICATION AND LIMITATION OF LIABILITY
NO EVENT WILL TDR BE LIABLE FOR ANY DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, THIS AGREEMENT, ANY BREACH OF THE TERMS OF THIS AGREEMENT BY ANY THIRD PARTY, ANY OWNER CONTENT, DEATH OR BODILY INJURY, EMOTIONAL DISTRESS, PROPERTY DAMAGE, AND/OR ANY OTHER DAMAGES RESULTING FROM ANY ACTUAL OR ATTEMPTED TRANSACTION BETWEEN HOSTS AND RENTERS, OR THE INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
BECAUSE TDR IS NOT INVOLVED IN TRANSACTIONS BETWEEN HOSTS AND RENTERS, IF A DISPUTE ARISES BETWEEN A HOST AND RENTER, THEY RELEASE TDR FROM ALL CLAIMS, DEMANDS, AND DAMAGES (ACTUAL AND CONSEQUENTIAL) OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, SUSPECTED AND UNSUSPECTED, DISCLOSED AND UNDISCLOSED, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES.
